TERMS AND CONDITION

第１条　はじめに

この利用規約は、株式会社便利堂（以下「当社」という）が運営する「コロタイプアカデミー」（以下「本アカデミー」という）を紹介するWEBサイト（以下「本サイト」という）と、ワークショップを受講される際の条件を定めたものです。この規約は、本アカデミーを受講されるすべての方（以下「利用者」という）に適用され、利用者はこの利用規約（以下「本規約」という）の内容に同意なく本アカデミーを利用することはできません。

第２条　本規約の変更について

1. 本規約は、当社と本アカデミーを利用するすべての利用者の一切の間において適用されるものとします。
2. 当社は、当社の判断において本利用規約の内容を変更できるものとします。変更する場合には、本サイトにおいて事前に変更の内容とその時期、変更後の本規約の内容について掲示いたします。

第３条　本アカデミーの内容の変更、一時停止、および停止・終了について

1. 当社は、当社の判断において本アカデミーの内容を変更できるものとします。
2. 業務上の都合や、必要不可欠なシステムのメンテナンスに伴う本サイトの一時停止は、利用者への事前予告なくおこなわれるものとします。
3. 本アカデミーの終了については、事前に本サイトで告知します。
4. 本アカデミーの緊急的な一時停止に伴い利用者に生じた損害について、当社は一切の責任を負いません。

第４条　本アカデミーの説明

本アカデミーでは、当社が提供する写真古典技法である「コロタイプ」を、利用者が学び、実践する場所を提供する目的で運営されています。

第５条　本アカデミーの利用に関する規則

1. 本アカデミーは、個人情報の収集を目的とした会員登録を必要としませんが、受講申込の際に個人情報を入力いただくことによって、受講申し込みをすることができます
2. 本アカデミーは、受講期日の一週間前を目処に、ワークショップで使用する利用者の画像を製版します。その日以降のキャンセルはお受けできません。

第６条　個人情報の取り扱いについて

1. 本アカデミーへのお申し込みで登録された個人情報は、当社が別に定める「個人情報保護方針」に従って適切に取り扱われるものとします。
2. 本アカデミーでは、お申し込みの際に「ニュースレターの配信を希望する」と登録された利用者に限り、そのメールアドレスを収集し、当社からの情報配信に利用できるものとします。なお、利用者が情報の配信停止を希望する場合には、当社指定の方法に則り配信停止を当社に連絡の上、当社は直ちにその手配を行うこととします。
3. 本アカデミーでは、ワークショップ終了後にアンケートを実施しています。アンケート用紙に記入された個人情報は、当社が別に定める「個人情報保護方針」に従って適切に取り扱われるものとします。

第７条　利用料金と支払い方法について

1. 本アカデミーの受講料は、各コース紹介ページに提示するとおりとします。
2. 本アカデミーの受講料は、受講の一週間前までにお支払いただきます。受講料の入金は、国内在住者には銀行振り込み、PayPal、クレジットカードでの決済を推奨する他、海外在住者へはPayPal、クレジットカード決済を依頼いたします。

第８条　知的財産権、および著作権について

1. 本アカデミーにて利用者が使用する画像の著作権は、いかなる場合も利用者本人に帰属します。
2. 利用者が使用する画像が、第三者の知的財産権やプライバシー、肖像権を侵害する内容であった場合に生じた紛争について、当社は一切の責任を負いません。
3. 本アカデミーを受講して作成された作品において、利用者が同意された場合にのみ、当社はその作品画像を作例として本サイトに掲載することができるものとします。なお、その利用者から、掲載の停止を依頼された場合には、その画像を本サイトより削除します。

第９条　画像データの保存と取り扱いについて

1. 当社は、利用者から提出された画像データの保存責任を負いません。
2. 利用者から提出された画像データは、ワークショップ終了後に随時削除いたします。再版をご希望される場合には改めて画像データを提出していただきます。
3. 利用者から提出された画像データは、システム上のトラブルのために消失することがあります。当社は、そのトラブルによる画像の消失にかかる責任を負いません。

第１０条　本アカデミーにおける画像処理の特性について

1. 本アカデミーにおいて、製版の仕上がりは利用者が提出する画像の品質によって変化します。サイズの見合わない小さな画像が提出された場合には、画質の荒い仕上がりになります。
2. 利用者が作業環境とするパソコンモニターやその色空間と、当社が基準とする作業環境に違いが生じる場合があります。版の仕上がりの違いに対し当社は一切の責任を負いません。
3. 当社は、本アカデミーの利用者から提出された画像の編集は行いません。提出される前に不備がないか改めてご確認ください。また、利用者のご希望に沿ったレタッチは承ることができません。

第１１条　禁止事項

当社は、利用者の行為が以下に掲げる各号のいずれかに該当する場合、利用者の本アカデミーの受講を謝絶できるものとします。
1. 本規約の内容に違反する行為
2. 当社、および第三者の著作権や商標権等の知的財産権を侵害する行為、またはその恐れのある行為
3. 当社、および第三者のプライバシーや肖像権を侵害する行為、またはその恐れのある行為
4. 当社、および第三者を誹謗中傷し、名誉や信用を毀損する行為、またはその恐れのある行為
5. 法令、および公序良俗に反する行為、またはその恐れのある行為
6. 差別的、および暴力的要求行為、反社会的行為、またはその恐れのある行為
7. 当社のサーバーに負担をかける行為、もしくはシステムに著しく負担をかける行為
8. コンピューターウィルス等を使用する行為
9. その他、当社が不適当と判断する行為

第１２条　免責事項

1. 当社は、本アカデミーの内容の変更等のための一時停止、終了を実施したことによって利用者に生じた損害について、一切の責任を負いません。
2. 当社は、利用者が提出した画像の適法性、正確性、道徳性について、一切の保証をいたしません。
3. 当社は、利用者が本アカデミーを受講するために作成したデータの保存について、一切の責任を負いません。
4. 当社は、利用者が作成した画像の、第三者の名誉毀損や知的財産権の侵害によって発生した紛争や損害等に対して一切の責任を負いません。

第１３条　準拠法および専属的合意管轄裁判所

1. 本規約の準拠法は日本法とします。
2. 当社と利用者の間で、本アカデミーにおける訴訟が生じた場合には、京都地方裁判所を第一審の専属的合意管轄裁判所とします。

Article 1 Introduction

These Terms of Use stipulate the terms and conditions of the website (hereinafter referred to as the “Website”) that introduces the “Collotype Academy” (hereinafter referred to as the “Academy”) operated by Convenient Hall Co. These terms and conditions apply to all people who attend the Academy (hereinafter referred to as “Users”), and Users may not use the Academy without agreeing to these terms and conditions (hereinafter referred to as “Terms and Conditions”).

Article 2 Modification of this Agreement

This Agreement shall apply to all users of the Academy. 2.The Company reserves the right to change the contents of this Terms of Use at its discretion. In the event of any change, the content and timing of the change, as well as the content of this agreement after the change, will be posted on this website in advance.

Article 3 Change, Suspension, and Termination of the Academy

  1. the Company reserves the right to change the contents of the Academy at its discretion.
  2. the Academy may be temporarily suspended without prior notice to the users due to business reasons or essential system maintenance.
  3. any termination of the Academy will be announced on this website in advance.
  4. the Company shall not be responsible for any damage caused to users due to the emergency suspension of the Academy

Article 4 Description of this Academy

The Academy is operated for the purpose of providing a place for users to learn and practice “Collotype”, a photographic classic technique provided by the Company.

Article 5 Rules for Using the Academy

  1. The Academy does not require membership registration for the purpose of collecting personal information, but you can apply for the course by entering your personal information when you apply for the course.
  2. The Academy will print the user’s image to be used in the workshop about one week before the due date of the course. No cancellation will be accepted after that date.

Article 6 Handling of Personal Information

  1. The personal information registered in the application to the Academy shall be handled appropriately in accordance with the “Personal Information Protection Policy” separately stipulated by the Company.
  2. The Academy will collect the e-mail address of only those users who have registered “I wish to receive the newsletter” at the time of application, and use it to send information from the Company. If the user wishes to stop receiving the information, the user shall notify the Company of the unsubscription in accordance with the method specified by the Company, and the Company shall immediately make arrangements for the unsubscription.
  3. The Academy conducts a questionnaire after the workshop. Any personal information entered in the questionnaire form shall be handled appropriately in accordance with the “Personal Information Protection Policy” separately stipulated by the Company.

Article 7 Fees and Payment Method

  1. the course fee of the Academy shall be as indicated on each course introduction page.
  2. the Academy’s course fee must be paid at least one week prior to the course. For those who live in Japan, we recommend payment by bank transfer, PayPal, or credit card, and for those who live overseas, we request payment by PayPal or credit card.


Article 8 Intellectual Property Rights and Copyrights

  1. the copyright of the images used by the users in the Academy belongs to the users themselves.
  2. the Company shall not be responsible for any disputes that may arise when the images used by the users infringe on the intellectual property rights, privacy, or portrait rights of third parties.
  3. The Company shall not be liable for any disputes that may arise in the event that the images used by the user infringe upon the intellectual property rights, privacy, or portrait rights of any third party. If the user requests that the image be removed from the site, the image will be removed from the site.


Article 9 Storage and Handling of Image Data

  1. The Company shall not be responsible for storing the image data submitted by the User.
    2 The image data submitted by the User shall be deleted at any time after the Workshop. If you wish to have a reprint, you will be required to submit the image data again.
  3. the image data submitted by the user may be lost due to system trouble. Our company shall not be responsible for the loss of images due to such troubles.


Article 10 Characteristics of Image Processing in the Academy

  1. in the Academy, the finish of plate making depends on the quality of the images submitted by the user. If a small image is submitted that does not match the size of the image, the result will be rough in quality.
  2. there may be a difference between the user’s computer monitor and its color space and our standard working environment. We will not be responsible for any difference in the finish of the print.

  3. We will not edit the images submitted by the users of the Academy. Please check the images again to make sure they are in order before submitting them. In addition, we cannot accept retouching according to the user’s request.


Article 11 Prohibited Matters

If a user’s actions fall under any of the following items, the Company may cancel the user’s enrollment in the Academy.

  1. violating the contents of this agreement
  2. Infringing or threatening to infringe on the intellectual property rights such as copyrights or trademarks of the Company or a third party
  3. Infringing or threatening to infringe on the privacy or portrait rights of the Company or a third party
  4. Defaming or threatening to defame the Company or a third party Acts that defame, libel, or damage the reputation or credibility of the Company or any third party, or that may do so. 5.Acts that violate or may violate laws, ordinances, and public order and morals
  5. Acts that are or may be discriminatory, violent demands, antisocial acts
  6. Acts that burden the Company’s server or significantly burden the system
  7. Acts that use computer viruses
  8. Any other actions that the Company deems inappropriate.

Article 12 Disclaimers

  1. our company shall not be responsible for any damage caused to the users due to the suspension or termination of the Academy for the purpose of changing its contents.
  2. our company does not guarantee the legality, accuracy, and morality of the images submitted by the users.
  3. The Company shall not be responsible for the storage of any data created by the User for the purpose of attending the Academy.
  4. our company will not be responsible for any disputes or damages caused by defamation of a third party or infringement of intellectual property rights of the images created by the user.

Article 13 Governing Law and Exclusive Jurisdiction

1.These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
2.In the event of a lawsuit regarding the Academy between our company and a user, the Kyoto District Court shall be the exclusive jurisdictional court of first instance.
